Supplementary Terms for Public Authorities

These supplementary terms apply in addition to the B2B Terms for municipalities, public institutions, and other public-sector clients. In case of conflict, these supplementary terms prevail for municipal contracts.
§ 1 Provider and Service
The provider is Alexander Göcke, Gartenexpedition, Fellackerstr. 4a, 47495 Rheinberg, Germany. Service scope and packages result from the Service Description and the Price Sheet.
§ 2 Term and Billing
Contracts are generally concluded as annual contracts and billed in advance by invoice. Automatic renewal occurs only upon express confirmation by the client. A one-time setup fee may additionally apply.
§ 3 Procurement and Documents
For annual contracts below the relevant procurement thresholds, direct award is often possible. The provider supplies the customary documents: terms, these supplementary terms, DPA, service description, and price sheet. Assessing procurement-law admissibility is the client's responsibility.
§ 4 Data Protection and Processing
Where personal data is processed on behalf, the Data Processing Agreement pursuant to Art. 28 GDPR applies. The municipal citizen front-end is designed so that no login is required for citizens and no unnecessary personal data is collected.
§ 5 Accessibility
The provider takes recognised digital accessibility standards into account (oriented towards WCAG 2.1 AA / BITV 2.0) and develops the solution accordingly. Specific commitments may be agreed in the individual contract.
§ 6 Branding and Content
The client provides the content required for municipal branding (logo, colours, texts) and is responsible for its lawfulness. The provider may name the municipality as a reference customer after coordination.
§ 7 Availability and Support
The provider endeavours to ensure reliable provision. Support is provided via email to anfrage@gartenexpedition.de during normal business hours. Extended service commitments may be individually agreed.
§ 8 Termination and Data Export
After contract end, municipality-specific content is, on request, exported in a common format (e.g. CSV) and subsequently deleted within a reasonable period, unless statutory retention obligations apply.
